Job overview

This is an exciting opportunity for a highly motivated individual to join the mental health legislation team as the trust lead for the Mental Capacity Act.

The successful applicant will have an in-depth knowledge and understanding of the Mental Capacity Act (MCA) and Mental Health Act (MHA) with experience of working within a complex health or social care organisation.

Using your knowledge of the MCA and your leadership skills, you will provide trust staff with expert support, information, training and guidance on issues relating to the MCA and DOL/ Liberty Protection Safeguards. The role also requires collaborative working and the development of effective multi-disciplinary and multi-agency relationships with all partner agencies, providing leadership and management of Deprivation of Liberty through provision of policy, governance and service development.

Main duties of the job

The post holder will be the Trust's designated lead for the Mental Capacity Act 2005 ('MCA'). Alongside Named Professional for Safeguarding Adults, you will be a source of advice in relation to MCA matters and act as a point of contact when the Trust is involved in any Court of Protection cases. You will be required to provide training for staff at all levels and provide credible analysis of the Trust's compliance with the MCA. The ultimate aim of the post is to assist the Trust in its aim to improve and maintain compliance with the MCA and other Mental Health Legislation

Detailed job description and main responsibilities

  • To be responsible for overseeing the operational delivery of the Mental Capacity Act (MCA) and Mental Health Act (MHA).
  • To ensure that systems are in place for relevant staff to notify the Trust of any usage of DoLS/LPS and to ensure records are maintained and disseminated as required by law.
  • To support and Named Professional for Safeguarding Adults as required.
  • To oversee the regular audits of the use of the MCA within the Trust, preparing trust level reports of any findings including highlighting good or poor practice.
  • Provide a visible and credible presence within the Trust in relation to all aspects of the MCA.

Person specification

Academic evidence of safeguarding knowledge

Essential criteria
  • Registered professional with 3 years relevant experience
  • Working knowledge of Safeguarding and MCA and MHA practice
  • Able to put together and deliver training packages
  • Demonstrable experience of Mental Health, Mental Capacity and DoLS/LPS services, issues and providing supervision
Desirable criteria
  • Demonstrable experience of working with Mental Health, Mental Capacity and DoLS cases and working in partnership with external agencies
  • Demonstrable experience of multi-agency collaboration and working across professional and organisational boundaries
  • An understanding of clinical governance and application to practice
  • Supervision qualification
